    • *   I understand that my child is to attend their school of origin until the Superintendent of Mercer County Schools makes his/her decision. This application process does not in any way exempt my child from compulsory school law.

    • *   I have read the Resident Student Transfer Policy of Mercer County Schools.

    • *   I understand that the Mercer County Superintendent may not consider this application until I have filled it out completely and correctly.

    • *  I understand that the Mercer County Superintendent may deny this application for the following reasons as they relate to my student: (1) lack of grade level capacity, (2) lack of programs or services due to areas identified in the county’s critical needs policy, (3) lack of appropriate staffing due to areas identified in the county’s critical needs policy, and/or (4) lack of appropriate staff, resources, services, and programs exist to meet the disability needs of a resident student.

    • *  I understand that the Mercer County Superintendent may revoke the transfer of my resident student if any of the following become relevant during the school year as they relate to my student: (1) lack of grade level capacity, (2) lack of programs or services due to areas identified in the county’s critical needs policy, (3) lack of appropriate staffing due to areas identified in the county’s critical needs policy, (4) lack of appropriate staff, resources, services, and programs exist to meet the disability needs of a resident student, (5) chronic absenteeism, (6) tardiness, (7) behavioral infractions categorized as Level 3 and Level 4 as defined in West Virginia Board of Education Policy 4373 (Expected Behavior in Safe and Supportive Schools), and/or failure to comply with the agreed upon conditions of the transfer between parents or guardians of the county school district. The agreed-upon conditions shall include a student’s continued violation of Mercer County School’s Policy J-18 (Expected Behavior in Safe and Supportive Schools), which may result in revocation of the student transfer at semester’s end.

    • *  I understand that the Mercer County Board of Education makes no promises or representations as to my student’s eligibility to participate in extracurricular activities at the requested school because the transfer is subject to the rules of the West Virginia Secondary Schools Activities Commission, over which the county board has no control.

    • *  I understand that my resident student if in grade levels Kindergarten (K) through Three (3) will have to apply for transfer annually.

    • *  I understand that my resident student if in grade levels Four (4) and above will automatically be re-enrolled at programmatic levels from one year to the next unless: (1) Mercer County Schools has reason to terminate the transfer for one of the three reasons listed above (lack of grade level capacity, lack of programs or services, or lack of appropriate staffing) or (2) I terminate the transfer. 

    • *  I understand that in the event that I receive an unfavorable decision in this application and wish to appeal that decision, I may appeal to the Mercer County Board of Education by contacting the Administrative Assistant to the Superintendent of Schools who shall schedule the appeal for the next available board meeting. Should I receive an unfavorable decision of the Board, I must submit my appeal to the State Superintendent of Schools within thirty (30) days of the decision.

    • * I understand that a student who receives approval for transferring to a school in another attendance zone shall be responsible for his/her own transportation. Transfer students may ride a Mercer County Schools’ bus on an established route accessible to them, on a space available basis, and with the approval of the Supervisor of Transportation. The maximum recommended time for students transported on a bus shall not apply to students riding a bus via an approved transfer request.

    • * I understand that if a bus on which a transfer student is riding exceeds the recommended capacity with students that do reside in the school’s attendance zone, the transfer student will relinquish his/her privilege of riding the bus and become responsible for his/her own transportation.

      The transfer application period opens on May 1 for the new school year and closes no later than fifteen (15) instructional days after the beginning of the current school year. Applications submitted outside this period will be considered on a case-by-case basis.

  • DECISION OF THE MERCER COUNTY BOARD OF EDUCATION

  • Decision of the Superintendent
  • The decision of the Mercer County Board of Education shall be forwarded to the West Virginia Department of Education within three (3) business days. I hereby inform the parent/legal guardian of the resident student applicant that he or she may appeal this decision to the State Superintendent of Schools within thirty (30) days, in accordance with West Virginia Board of Education Policy 7212, which can be found online at: https://apps.sos.wv.gov/adlaw/csr/readfile.aspx?DocId=54867&Format=PDF
